Ellis III …said he was satisfied after receiving a secret written briefing from the director of central intelligence that allowing al-Masri's lawsuit to proceed would harm national security.”

The circle is closed. The Bush regime's security apparatus can’t be held accountable because doing so would endanger national security. Presumably Judge Ellis would say that his ruling can’t be challenged because asking him to reveal his reasons would also harm national security.
